You make the argument that upstairs she heard what was going on and should have come down stairs to intervened. Legally that would have been the wrong move. That would have made her culpable. She could then be convicted as contributing to the murder. Staying upstairs gives her plausible denial. It is why they wrote it that way. That is also why during the meeting nothing about killing was ever mentioned or insinuated. For added measure to provide dying was not a for gone conclusion. They staged the exact same action with Chavez without killing anyone.
This is a ridiculous argument not real life because if in real life you sat upstairs in your own home with 3-5 men, who you left your door open for,attacking a women and a child downstairs and you did nothing to stop it it is a prosecutable offense. Plus she walked downstairs saw blood picked up the kid and walked out with a man with blood all over his face so she basically kidnapped this kid, then overheard the man with her tell someone on the phone to kill them all and again did nothing.
But enough because I like when we discuss don't like when we argue
