Because that is what happened people assume Sean knew what he was asking her to do. Based on the show Sean only asked for Adalind to make Hank infatuated with her. That is why Sean sent the guy to make Hank jealous.
This is interesting. So Sean might not be convicted of conspiracy to murder after all then?
Sean's intention doesn't matter in this case. It's not like he just told Adalind to get him to fall for you and make him jealous. It went past that once the cookies came into play. Hank was intentionally drugged once those cookies were given to him. Hank dying as a result makes him guilty.
There was a show titled Breakout Kings a handful of years back. One of the characters sold drugs to support his mother. One of his customers was a teenage girl who died as a direct result of the drugs he sold her. He got sentenced to more than 20 years in jail because the girl dying was considered murder despite him not trying to harm anyone.
In this case, Renard is guilty because he told Adalind to essentially drug Hank and gave her Hank's blood so she could do it. He's guilty of any damage caused by Adalind making those cookies.
