This is what I thought, the one who solicits a crime is just as guilty as the one who actually commits the crime if not more so, whether the intended target is the victim or someone else is as a result of intercepting the crime in progress or both/more individuals end up being victims by chance. Under these circumstances, the prosecutor would try and make a deal with Adalind (possible reduced sentence) in order to get Sean (the real master mind) convicted since Adalind is merely a tool in Sean's hand. Like I said both are guilty for their part in what happened to Hank and Wu.
