A lot is based on how he handled his mom bringing Diana. Also the writing does not contain any talk of continued linage, or legacy. There is no talk of the continuation of the burkhart name. Basically even if Kelly was not his, I do not see how the episodes would be any different. The only time the Kelly being his was an issue was at the police station. But even that they added Adalind putting Nick hand on her stomach. Nick not demanding paternity was made a non issue.
I have a theory why they made it a non issue. ADalind was Juliette at the time she sleep with Nick. Addressing paternity would then open up the is Kellly really hers or is she just a surrogate for Juliette. I remember the argument was that it was just a glamour so it was always Adalinds body. Then they had Eve become Sean and have sex with Rachel. The killed the glamour. Bottom line we have no idea how it would logically work. Meaning we can not even speculate on the validity of a paternity test. Add to that the show adding the two heart beat story line. Just more reason not to go down the paternity story line. But so Nick would not seem clueless. They ran with Kelly is a child he thinks might be his, but even if not, is a child he needs to protect. The show even wrote having Sean accept Kelly as his. There was no reason to add that unless they wanted to show how we are to view paternity.
