I believe that both of them acts out of the law and that none of them has this right. The message is the same from both characters: The ends justify the means.
This is a good, tough question. Of the two, Nick's actions are the most criminal in my opinion.

How we view the series makes for the discussion (my option). Police series Nick has to be a police office first and a Grimm second. Grimm series Grimm first police office second.

There is a post from @Hyndara where it is written that the creators of the show wanted the grimm thing... But NBC wanted Nick to be a cop.

Just to be clear, I like the cop think in the show, but I think this could be more explored... All those talks we have about Nick being or not a good guy I think this should be used in the show... Like Nick should be wondering if he should be more grimm or more cop... Or the writers could have created a debate between Hank and Nick where Nick Always tring to be more grimm and Hank pushing him to be more cop. But the show doesn't explore this possibility.
If we pay atention on how the show develops, the writers are always developing the grimm think... even creating all the royals plot...while the cop stuff is being left behind each episode.
That is way, I think, each time Nick faces a wesen he is more grimm and less cop and no one inside the show criticizes him. It is not because the writers forget the cop show or want that Nick became a bad guy... but because the creators priorities are the grimm mistery... and not the cop show. The cop show is just the background.
That is my 2 cents... I maybe wrong... That is why just 2 cents.
