No one gave the word to kill her, js. I just assumed it was so because Hank apparently was shooting to kill. What I mean is, he wouldn't shoot just to wound her, would he?
With the drug war heating up a person on drugs a 38 might not stop them. I would bet they do use jacketed ammo so wounding is possible so shooting center of mass doesn't mean they were shooting to kill, there are types of 40 cal ammo that any hit would be fatal. Now take the distance at that distance with a handgun you would have to very good to hit and arm or leg but you still would have to miss the arteries. Way to much info likely sorry.
